Peter Trigger, a male who identifies as a trans woman, was convicted of a catalogue of harassment and exposure charges between 2008 and 2010. A court was told Trigger “wants, for want of a better phrase, to be a girl. He’s the way he is and that’s why he feels victimised.”

December 2008: Trigger received a five-year ASBO after repeatedly – for over a year – waiting near a primary school in Northampton dressed as a schoolgirl in a local school’s uniform when children were on their way to and from school, following children and behaving in an inappropriate manner. As well as dressing as a schoolgirl, Trigger was also often seen wearing a knee-length lab coat with what appeared to be nothing underneath. Trigger, 62, received a 12-month community order with supervision and a tagged curfew, to coincide with the time constraints of the ASBO to ensure there is no repeat of wearing a skirt when prohibited from doing so.

Specifically, the ASBO banned Trigger from wearing a skirt or showing bare legs on a school day between 8.30am and 10am, and 2.45pm and 4pm. He was also banned from behaving in a manner which causes or is likely to cause harassment, alarm or distress to others.

February 2009: Trigger was convicted of exposure and given a suspended sentence of 12 weeks’ imprisonment, suspended for three years. He was also required to complete a sex offender programme and register with the police for seven years.

May 2010: Trigger was found guilty at Northampton Magistrates’ Court of breaching the ASBO by deliberately bending over in front of his neighbours early in the morning on 16 December 2009, causing them harassment, alarm and distress. Chairman of the Bench told him “You have the human right to dress as you wish but your actions must not cause harassment, alarm or distress.” While finding him guilty of harassing his neighbours, magistrates declined to activate the suspended prison sentence, partly because Trigger was the carer for his aged mother. Trigger was also fined £100 and ordered to pay £300 court costs and £15 to his victims.

October 2010: Trigger was fined for failing to comply with notification requirements under the Sexual Offences Act 2003. The suspended sentence was also activated, with Trigger being ordered to immediately serve eight weeks of the 12-week sentence imposed in 2009.

February 2011: Trigger appealed his sentence in the High Court and Lord Justice Moore-Bick and Mr Justice Ramsey ruled the jailing order was not valid. They ruled the magistrates had erred “in failing to take account of matters that were relevant to the decision whether to vary the claimant’s sentence 20 months after it was originally passed”.
