Kyle Waugh/Kimberley Smith, a violent male who identifies as a transgender woman, was convicted at Falkirk Sheriff Court in November 2024 of sexual assault, multiple counts of threatening behaviour and breaching curfew. As Waugh/Smith was already in prison for previous offences until at least December 2024, the sheriff deferred sentence until February 2025.

Waugh/Smith, a 25 year old serial violent offender, touched a man’s genitals over his clothing and engaged in threatening behaviour at Glasgow Queen Street Railway Station in August 2022. Waugh/Smith was also convicted of punching and kicking inside a police van when arrested in early September and threatening behaviour towards police officers on another occasion in August 2022. Media avoided referring to Waugh/Smith as a ‘woman’ – instead using ‘sex offender’ in headlines – but used female pronouns in the copy and highlighted that prison was ‘very difficult for her’.

At previous court appearances in September 2024, Waugh/Smith was convicted of assaulting a taxi driver and causing hundreds of pounds worth of damage to his car after failing to pay a fare. When police arrived, Waugh/Smith shouted, swore, spat at and tried to kick officers, refused to get into a police van, went rigid, and had to be taken to the ground. Waugh/Smith was only brought under control when a spit hood was applied. After being convicted of assault, police assault, fare fraud, resisting arrest, and statutory breach of the peace, Waugh/Smith was jailed for six months, to be served at HMP Low Moss, a male prison for offenders serving sentences shorter than 36 months. The court heard Smith had 17 previous convictions for a variety of “broadly analogous” crimes that were related to excess alcohol.
