Nathan Johnston, believed to be a female who identifies as a transgender man, was charged with attempted murder, assault to severe injury, permanent disfigurement and danger to life at Kirkcaldy Sheriff Court on 21 October 2024.

Johnston, 25, was initially taken to HMP Perth, a men’s prison, and processed as a man – reportedly based on appearance and incomplete paperwork relating to the sex of of the prisoner being sent via police. However, after a detailed search, staff realised the prisoner was female and Johnston was kept in segregation before being moved to a female prison the next day.

An urgent review of procedures has apparently been instigated after Police Scotland and the Scottish Prison Service confirmed the error.
